What is an assigment & transfer of personal property to revocable living trust? Does it help avoid probate?
My dad passed away without "properly" funding his trust. We found a form with his trust titled "assignment & transfer of peronal property to revocable living trust" that states he transferred all his property to the trust. If he did not draw a new deed stating the trust owns the property, does this form help at all to void probate? What is it for?
Anything with a title is NOT covered by the transfer. The assignment and transfer would apply to items such as clothing, furniture,etc. Cars, homes, and other Real Estate most be retitled to the trust BEFORE death. That is what in meant by not properly funding the trust. In the case you describe, your dad WASTED whatever it cost to set up a trust that doesn't actually own the assets it was set up to own.
One simple answer to the question why you need a trust is to avoid probate. If you die in San Diego without a will or a trust, your estate will have to go through probate, a costly procedure in California in terms of probate fees, time, and emotional toll on your loved ones. There is no question that with a living trust, the administration of your estate can be a lot easier, usually with less cost and in less time.
Aside from the advantages of no probate, there are other, perhaps even more important, reasons that you should consider having a living trust.
If you become incapacitated, even temporarily, who is going to take care of your assets, write bills for your medical care, pay house payments, taxes, and other expenses? With a revocable living trust, you appoint individuals who you trust to act as successor trustees upon your death but such individuals can also step in and act for you during a period of incapacity.
Other reasons for setting up a trust?
1. Providing for your minor children, not only for the purpose of naming a guardian should something happen to you, but also to structure how they would receive their inheritance, whenever it happens. Do you really want your children to inherit their entire inheritance when they are 18? A trust enables you to designate the ages and the increments at which your children will receive distributions.
2. Leaving a cash bequest or property to a charity. Without a trust (or a will), no part of your property can be distributed to a charitable organization.
3. Leaving all or part of your estate to a friend. Similarly, if you want to leave something to a friend, only a trust (or a will) can accomplish this. The Probate Court can never distribute assets to someone who is not your heir if you have not created a trust or a will.
4. Providing for a disabled beneficiary. One of the advantages of a living trust is that you can structure a type of trust called a special needs trust to leave assets to a disabled beneficiary who is receiving or might be receiving public benefits.
5. Eliminating or reducing estate taxes. For married couples, the appropriate type of trust can eliminate or substantially reduce estate taxes to be paid from your estate.
Dying without a will or trust can have unintended results upon your death. A will can accomplish some of the goals discussed above but remember a will has to do through probate. The cost of creating a revocable living trust is more than offset by the advantages of creating one.
